Facing Disciplinary Action, Removal or Dismissal from Thai Public Service?
An investigation notice or disciplinary order can affect a public servant’s career, income and long-term benefits. Before predicting an outcome, establish the present stage of the case and the legal procedures that apply.
“I have received notice of a serious disciplinary investigation. Can I be dismissed, and will I be allowed to respond?”
An investigation does not itself constitute dismissal. Review the allegations, documents and evidence provided, opportunities to respond and deadlines under the specific statute governing that public servant.

Deadlines vary by category of public servant
For ordinary civil servants governed by the Civil Service Act B.E. 2551 (2008), disciplinary sanctions are generally appealed to the Merit Systems Protection Commission (MSPC) within 30 days of actual or deemed notice. A challenge to an MSPC appeal decision is generally brought before the Supreme Administrative Court within 90 days of actual or deemed knowledge of that decision. Teachers, police, local-government personnel and special statutory cases may follow different routes and timelines.

30 Practical Questions on Thai Public Service Discipline
Organized by procedural stage; not presented as a verified ranking of popular searches or case outcomes.
Facing a Disciplinary Investigation
Understand the allegations and your response rights before any penalty is imposed.
01 Under investigation for serious misconduct: will I be dismissed immediately?
An investigation is not itself a penalty. Review the allegations, duties, investigation procedures, evidence, and response deadline under the applicable public-service law.
02 Accused of corruption without receiving money personally—what matters?
Personal gain is not the only relevant element. The conduct, intent, duties, authority and available evidence need independent assessment.
03 Can personal errands during official hours result in serious discipline?
The applicable rules, duration, consequences and circumstances matter. No penalty can be predicted from this fact alone.
04 Punished without being told the allegations or allowed to respond?
Review notice of allegations, supporting evidence, the right to respond and appeal routes. A procedural defect does not automatically erase all underlying allegations.
05 Absent more than 15 days due to illness: can medical documents help?
Keep contemporaneous medical records, leave requests and notice to supervisors. The specific statutory threshold, relevant dates and reasonable cause must be examined.
06 Suspended or temporarily removed during an investigation: can I return to work?
Identify the exact order, its legal basis and any available grievance or review procedure. Temporary measures differ from final disciplinary sanctions.
07 Accused of abandoning duty while assigned to another agency?
Preserve assignment orders, work logs, attendance records, reports and witnesses confirming the authorized assignment.
08 Can a potentially biased investigation committee member be challenged?
Check statutory impartiality rules and objection procedures. Document verifiable conflicts rather than relying on assumptions.
Sanctions and Disciplinary Appeals
Check service dates, competent review bodies and supporting evidence.
09 Can dismissal be reduced to removal from service?
Review the sanction, statutory offense, competent review body and appeal procedure. A reduction is never guaranteed.
10 What is the difference between removal and dismissal for pension rights?
Different types of sanction can carry different pension consequences. The applicable service and pension statutes must be identified first.
11 How should a disciplinary appeal be written?
Identify the order, date of notice, facts, legal objections, supporting documents and requested remedy; file with the correct body before the statutory deadline.
12 Does a clean 20-year service record reduce the penalty?
It may be a relevant consideration in some cases, but it does not automatically reduce a mandatory or serious disciplinary sanction.
13 Why can disciplinary sanctions remain after government losses are repaid?
Compensation and disciplinary liability are legally distinct. Review how repayment relates to the facts and the applicable sanction rules.
14 Is a three-month 5% salary deduction serious discipline?
For ordinary civil servants, salary deduction is generally classified as non-serious discipline. Verify the applicable service system and the actual order.
15 Can a salary reduction imposed after a recent raise be appealed?
Check the precise sanction, authorized decision-maker, reasons and appeal route under the applicable rules.
16 My MSPC appeal has been pending for three months—can I sue now?
Check the stage of the appeal and the applicable provisions. Three months of waiting does not automatically open the same court route in every case.
Dismissal, Reinstatement and Benefits
Distinguish challenging the original decision from seeking a new appointment.
17 Dismissed two years ago: can I return to public service?
Distinguish overturning the old order from applying for a new appointment, and assess deadlines and legal eligibility.
18 What is the court deadline for challenging a dismissal?
Identify the employment system first. For ordinary civil servants, a 30-day MSPC appeal and a 90-day Supreme Administrative Court period after an MSPC decision generally apply, subject to statutory exceptions.
19 If a court quashes dismissal, do I get back pay and my old post?
It depends on the judgment, legal basis and remedies claimed. Back pay or automatic restoration of the same post cannot be guaranteed.
20 Does criminal acquittal automatically remove a disciplinary sanction?
Criminal and disciplinary liability can have different legal tests and evidence. Read the grounds for acquittal and the disciplinary record.
21 Can someone dismissed for corruption return to government service?
Eligibility depends on disqualifications, applicable statutes and the status of the prior order or judgment; there is no universal waiting period.
22 Do pension rights remain after removal followed by private-sector work?
Examine the type of separation, credited service and pension legislation applicable to the person.
23 What does the Administrative Court review after an MSPC rejection?
It examines the legality of the challenged decision and relevant process and evidence. No credible fixed win percentage can be supplied.
Procedural Rights, Deadlines and Evidence
Technical procedural issues can materially affect available remedies.
24 Must I retain a lawyer for a disciplinary appeal?
Not invariably. Individuals may use available statutory procedures themselves; lawyers can help check the record, legal grounds and deadlines.
25 Is legal aid available for public-service disciplinary matters?
Check eligibility with appropriate legal-aid providers, professional bodies and government services before assuming assistance is available.
26 Does refusing to receive a dismissal order stop the appeal clock?
Deemed-notice rules may apply. Do not rely on avoiding service; determine when the order was legally communicated.
27 How are multiple disciplinary allegations assessed?
Assess the facts, evidence and statutory elements for each allegation and the rules governing the resulting sanction.
28 Can recordings or LINE chats support an allegation of unfair treatment?
Preserve original files, context, provenance and timestamps. Admissibility and weight depend on reliability and applicable law; do not edit recordings.
29 Can private conduct such as debt or relationships lead to serious discipline?
The specific conduct, relevance to public office and statutory definition of misconduct require careful assessment.
30 What happens to pension rights if proceedings continue after retirement?
Review the status of proceedings, applicable pension provisions, agency orders and any eventual decisions.
